BuildInvoice Privacy Notice

This BuildInvoice Privacy Notice explains how Debora T DiBiasie, doing business through AltaVida Capital, operates BuildInvoice and collects, uses, stores, processes and discloses information through the BuildInvoice application, website, mobile interfaces and related services.

This Notice supplements the AltaVida Capital Privacy Policy, Terms of Service, and Cookie Policy. If this Notice conflicts with the general AltaVida Capital Privacy Policy concerning information processed specifically through BuildInvoice, this Notice controls with respect to that information.

For purposes of this Notice:

“BuildInvoice,” “we,” “us” and “our” refer to Debora T DiBiasie, doing business through AltaVida Capital, in connection with the operation of the BuildInvoice digital service.
“Customer” means the contractor, tradesperson, business owner, company, account holder or authorized representative who creates or uses a BuildInvoice account.
“Customer Data” means information entered, uploaded, generated, stored or transmitted by or for a Customer through BuildInvoice.
“Client Data” means information concerning a Customer’s clients, customers, property owners, vendors, workers, subcontractors or other third parties.
“Services” means the BuildInvoice application and its invoice, estimate, proposal, change-order, field-capture, project-record, document-generation and related features.

Scope

This Notice applies to information collected through:

BuildInvoice account registration and authentication;
customer profiles;
company profiles;
project and job records;
client records;
invoices;
estimates;
proposals;
change orders;
daily logs and field captures;
labor, material and measurement records;
document uploads;
voice or text input;
generated PDFs and reports;
email delivery;
customer support;
payment and subscription activity, when activated;
application analytics and security logs; and
other BuildInvoice interactions.

This Notice does not govern the independent privacy practices of a Customer, the Customer’s clients, payment processors, financial institutions, government agencies or other third parties.

Roles and responsibilities

BuildInvoice provides software that allows Customers to organize and process business and project information.

Depending on the circumstances:

BuildInvoice may determine how account, security, billing, support, and operational information is processed to provide, secure, administer, and improve the Services and for other purposes described in this Notice.
BuildInvoice may process Client Data on behalf of a Customer according to the Customer’s instructions and use of the Services.
The Customer remains responsible for determining whether it has lawful authority to collect, use, enter, upload, store or disclose Client Data through BuildInvoice.
The Customer remains responsible for providing its own clients, employees, subcontractors and other affected persons with any legally required privacy notices.
The Customer remains responsible for obtaining any legally required permission or consent before recording, transcribing, photographing, uploading or sharing information concerning another person.

BuildInvoice does not independently establish the Customer’s legal basis for collecting Client Data and does not replace the Customer’s own privacy, employment, consumer, contract or recordkeeping obligations.

Information collected from Customers

We may collect the following information from or about a Customer.

Account and identity information

This may include:

name;
business name;
email address;
telephone number;
mailing or business address;
username;
account identifier;
authentication status;
login history;
access permissions;
language preference;
account settings; and
security-related information.

Business profile information

This may include:

trade or industry;
company name;
company logo;
license or registration information voluntarily entered;
tax or business identifiers voluntarily entered;
service descriptions;
payment instructions;
invoice terms;
document numbering preferences;
branding preferences;
employee or authorized-user information; and
other business details selected by the Customer.

Customers should not enter information that is unnecessary for preparing or managing their business documents.

Project and transaction information

This may include:

project name;
job location;
project description;
scope of work;
labor entries;
material entries;
quantities;
measurements;
rates;
taxes;
discounts;
deposits;
payments;
balances;
completion status;
change orders;
daily logs;
photographs;
attachments;
notes;
approval information; and
related communications.

Voice, dictation and transcript information

When voice or dictation features are used, BuildInvoice may process:

audio provided through the Customer’s device;
raw transcripts;
corrected transcripts;
language selections;
field notes;
spoken project descriptions; and
related technical information.

The Customer should not record another person without any notice or consent required by applicable law.

Unless expressly stated otherwise, BuildInvoice’s voice features are intended to convert Customer-provided speech into text or structured business records. They are not intended for covert recording, surveillance or biometric identification.

Support and communications

We may collect information contained in:

support requests;
emails;
chat interactions;
troubleshooting records;
correction requests;
customer feedback;
account-recovery communications; and
other correspondence.

Payment and transaction information

If paid services are activated, we may collect:

purchaser name;
billing address;
subscription or plan;
transaction date;
amount;
payment status;
transaction identifier;
refund information; and
limited payment-related information received from a payment processor.

If payment-card processing is activated, complete payment-card information should be submitted only through the designated payment-processing system and not entered into ordinary BuildInvoice fields or records.

Client Data entered by Customers

Customers may enter information concerning clients, property owners, vendors, workers, subcontractors or other persons.

Client Data may include:

name;
business name;
email address;
telephone number;
project or service address;
billing address;
project details;
invoice or proposal information;
payment status;
correspondence;
approvals;
signatures, if activated;
photographs;
documents; and
other information necessary to perform or document the Customer’s work.

Customers must not use BuildInvoice to collect or store information they are not authorized to possess.

Customers should not enter the following unless a specific secure feature requests it and its use has been approved:

Social Security numbers;
complete payment-card numbers;
complete bank-account numbers;
account passwords;
authentication codes;
government login credentials;
unredacted tax returns;
complete medical records;
biometric identifiers;
immigration documents;
unrelated identity documents;
private encryption keys; or
other unnecessary highly sensitive information.

How information is used

We may use information to:

create and administer accounts;
authenticate Customers;
provide application access;
save drafts;
create client and project records;
generate invoices, estimates, proposals and change orders;
calculate totals;
organize labor and material information;
generate PDFs and bilingual documents;
deliver requested documents;
synchronize records across authorized devices;
provide customer support;
troubleshoot technical issues;
maintain backups;
protect account and application security;
detect fraud, abuse and unauthorized access;
apply usage limits;
improve features and performance;
maintain consent and transaction records;
process payments and refunds;
comply with legal obligations;
enforce applicable agreements;
investigate disputes;
respond to lawful requests; and
carry out other purposes disclosed when information is collected.

We will not intentionally use Client Data for a materially unrelated purpose without appropriate notice, authorization or another lawful basis.

Customer ownership and limited processing permission

As between BuildInvoice and the Customer, the Customer retains its rights in Customer Data and Client Data, subject to the rights of the individuals and organizations to whom the information relates.

The Customer grants BuildInvoice a limited, nonexclusive permission to host, store, organize, reproduce, transmit, format, convert, back up and otherwise process Customer Data only as reasonably necessary to:

provide the Services;
generate requested documents;
deliver requested communications;
maintain security;
provide support;
comply with law; and
enforce the applicable agreement.

This permission does not transfer ownership of the Customer’s business records to BuildInvoice.

BuildInvoice may use deidentified or aggregated information to understand application performance, improve features, prevent abuse and evaluate general usage patterns, provided the information is not used to identify the Customer, the Customer’s client or another individual.

Artificial intelligence, automation and transcription

BuildInvoice may use rules, templates, automated calculations, transcription tools or artificial-intelligence-assisted systems to:

convert speech into text;
organize field notes;
classify document entries;
format invoices and proposals;
translate or assist with bilingual presentation;
identify incomplete fields;
suggest document language;
summarize Customer-provided information;
generate drafts; and
improve workflows.

Automated outputs may contain errors, omissions or incorrect interpretations. Customers must review all invoices, estimates, proposals, change orders, translations, calculations and generated documents before sending, approving or relying on them.

BuildInvoice will not intentionally submit highly sensitive information to a general-purpose artificial-intelligence provider unless the processing is reasonably necessary, approved for that purpose, subject to appropriate protections and permitted by law.

Customer Data will not be used to train a general-purpose public artificial-intelligence model without clear notice to the Customer and any consent or other choice required by applicable law.

Service providers and subprocessors

Depending on the features activated, BuildInvoice may use service providers for functions such as:

application hosting;
database storage;
authentication;
cloud infrastructure;
email delivery;
document and PDF generation;
transcription;
translation;
error monitoring;
analytics;
customer support;
payment processing;
backups;
security;
software development; and
other operational services.

Service providers may process information as necessary to perform the services they provide to BuildInvoice, subject to applicable contractual, confidentiality, privacy, and security obligations.

Disclosure of information

We may disclose information:

At the Customer’s direction

This may include sending documents or information to:

the Customer’s client;
an authorized employee;
a subcontractor;
a business partner;
an accountant;
a bookkeeper;
a payment provider;
a professional advisor; or
another recipient selected by the Customer.

To service providers

We may disclose information to providers that perform operational functions on our behalf.

For legal, security and safety purposes

We may disclose information when reasonably necessary to:

comply with applicable law;
respond to a subpoena, court order or lawful request;
protect rights, property or safety;
prevent fraud or misuse;
investigate a security incident;
enforce agreements; or
establish, exercise or defend legal claims.

In a business transaction

Information may be disclosed in connection with a merger, financing, reorganization, asset transfer, acquisition or sale of all or part of the business, subject to applicable legal and contractual protections.

With valid consent or authorization

We may disclose information when the affected person or authorized Customer directs or authorizes the disclosure.

No sale of Client Data

BuildInvoice does not sell Client Data or use Client Data for cross-context behavioral advertising.

BuildInvoice does not place advertising pixels or retargeting technologies on application pages where Customers enter client, project, payment, financial, or other sensitive business information.

Data retention

We retain information only for as long as reasonably necessary for:

account administration;
providing the Services;
maintaining Customer records;
generating and delivering documents;
security;
backup and recovery;
dispute resolution;
legal compliance;
accounting and tax records;
enforcement of agreements; and
other disclosed business purposes.

After account closure, Customer Data may be retained for a limited period and then deleted or deidentified, unless continued retention is reasonably necessary for legal, security, backup, fraud-prevention, transaction, or dispute purposes.

Deletion from active systems may not immediately remove information from backups or records that must be retained for legal, security, fraud-prevention, transaction, or dispute purposes.

Customer instructions and deletion requests

A Customer may request access, correction, export or deletion of Customer Data by using available account controls or contacting BuildInvoice.

When a request concerns Client Data entered by a Customer, the affected individual should ordinarily direct the request to the Customer who controls the business relationship. BuildInvoice may assist the Customer in responding where technically feasible and legally required.

BuildInvoice may require identity and authority verification before processing a request.

Security

BuildInvoice uses reasonable administrative and technical safeguards, and physical safeguards where applicable, designed to protect information based on its nature and sensitivity.

Safeguards may include:

encrypted transmission;
encryption at rest where supported;
authentication;
role-based access;
least-privilege permissions;
database security policies;
rate limiting;
logging;
monitoring;
backups;
software updates;
vulnerability remediation;
vendor review;
access restrictions;
incident-response procedures; and
confidentiality obligations.

No system can guarantee absolute security.

Customers are responsible for:

protecting passwords and access links;
controlling authorized users;
securing their devices;
promptly removing former employees or users;
retaining independent copies of important records; and
reporting suspected unauthorized access.

Security incidents

If a security incident affects information processed through BuildInvoice, we may take steps appropriate to the nature and scope of the incident, including investigating, containing and remediating the incident, preserving evidence, engaging appropriate service providers or professional advisors, and providing notices required by applicable law or contract.

Customers must promptly notify BuildInvoice of suspected unauthorized account access or misuse.

Cookies and application technologies

BuildInvoice may use cookies, local storage, authentication tokens, device identifiers and similar technologies for:

login and authentication;
account security;
session management;
saving progress;
maintaining draft information;
preserving settings;
preventing duplicate submissions;
applying rate limits;
troubleshooting;
measuring application performance; and
maintaining consent records.

Nonessential analytics technologies, if used, will be handled according to applicable notice and consent requirements. Advertising pixels and retargeting technologies are addressed in Section 10 of this Notice.

Children

BuildInvoice is a business productivity application and is not intended for use by children under 13.

Children under 13 may not:

create an account;
submit personal information;
upload content;
use voice features; or
enter client or project information.

If we learn that information was submitted directly by a child under 13 without legally sufficient authorization, we may delete the information and restrict the associated account.

International processing

BuildInvoice is operated from the United States. Information may be stored or processed in the United States and other countries where approved service providers operate.

Customers who use BuildInvoice outside the United States are responsible for determining whether their own collection and use of Client Data complies with applicable local law.

Changes to this Notice

We may update this Notice to reflect changes in:

BuildInvoice features;
data practices;
service providers;
security procedures;
legal requirements;
subscription plans; or
business operations.

The revised Notice will display an updated date. Additional notice or renewed consent will be provided when legally required.
